Who is Rahul Gandhi:

Rahul Gandhi is an Indian politician and member of the Indian National Congress party. He is the son of former Prime Minister of India, Rajiv Gandhi, and former President of the Indian National Congress, Sonia Gandhi. Rahul Gandhi was born on June 19, 1970, in New Delhi, India. Yet when Modi’s BJP crushed Gandhi’s party in the last two general elections, Gandhi was mostly written off. Gandhi’s Congress party, once an unstoppable force in Indian politics, has struggled to win over voters and repair a reputation marred by corruption scandals and leadership exoduses.

Why Rahul Gandhi Disqualified:

The court had previously informed the CM a month before this statement that year: “It (a defamation lawsuit) amounts to restricting free expression. Tolerance for criticism must exist. There is no way to utilise the defamation law as a political toolback. The year is 2023, and Rahul Gandhi, the head of the Congress party, has been expelled from the Lok Sabha after being found guilty in a criminal defamation case brought by BJP member Purnesh Modi in a Surat court.

Rahul is prohibited from returning from the date of his conviction “for a further term of six years following his release” in accordance with Section 8 of the Representation of People Act. This indicates that, if the court’s decision were to stand, he would be ineligible for eight years in total, including the jail sentence imposed by the court. Rahul might not be eligible to run in the Lok Sabha elections in 2024 as a result.

Rahul Gandhi was previously elected as a Member of Parliament (MP) in the Lok Sabha from the Amethi constituency in Uttar Pradesh. However, a recent notification from the Lok Sabha Secretariat has stated that Rahul Gandhi, who is currently representing the Wayanad parliamentary seat in Kerala, has been disqualified from the Lok Sabha due to his conviction by a Surat court in a 2019 defamation case. As a result of this conviction, Rahul Gandhi has been sentenced to two years imprisonment by the court.

what is Representation of People Act

The Representation of the People Act, 1951 is an act of Parliament of India to provide for the conduct of election of the Houses of Parliament and to the House or Houses of the Legislature of each State, the qualifications and disqualifications for membership of those Houses, the corrupt practices and other offences at or in connection with such elections and the decision of doubts and disputes arising out of or in connection with such elections. It was introduced in Parliament by law minister Dr. B.R. Ambedkar. The Act was enacted by the provisional parliament under Article 327 of Indian Constitution, before the first general election.[1]
